Did Moussaoui really lose? He never denied participating in the 911 plot. His lies helped to kill over 3,000 lives. He would have killed more if he could have. He laid out everything in open court. In blatant defiance he challenged the courage and will of America. And he won. Despite all that was freely admitted the jihadists now know that Americans are both unwilling to die for what they believe and are unwilling to kill their enemies. Something they are more than willing to do themselves.

We know at least the government did not. After almost 5 years of work, millions of dollars spent, and thousands of man hours working to do one thing–get Moussaoui the death penalty, it didn’t work. Is it the incompetence of federal prosecutors, a dense jury? Or, as some are arguing , was this case overcharged from the beginning?

In the end America has told the government and the people (including the world) that it no longer has the stomach for true justice. This is something Ms. Underestimated understands as well. The Jawa Report says it was a travesty of justice. That is absolutely correct but somehow doesn’t seem to carry the full weight of what happened.
