Settlement over trashed lottery ticket

Wizbang and I caught the news about a man who recovered a winning “Hold ‘em Poker” lottery ticket. The man found the winning ticket in the trash. Kevin Donovan, 49, said he bought every ticket but accidentally threw out the winner.

The initial ruling of the Lottery Commission said only possession was needed as the ticket was like cash. A ruling that left Kevin no longer “Hold ‘em”. Shortly after this he died. The cause was a heart attack. But the family kept up the fight to regain the lost family treasure.

The man who found the ticket, Edward St. John, 83, believed he was entitled to the entire $1 million. However, knowing his age and the court system he decided to settle.

Donovan died of a heart attack shortly afterward. His surviving children then challenged the commission ruling in court.

St. John’s attorney, Scott Ambler, said his client was reluctant to agree to the settlement because he believed he deserved the entire prize. But Ambler said that Donovan’s estate could have conceivably kept the case in court for so long that St. John might have died before it was resolved.

Not a bad deal. Someone else paid for the ticket and the man has over $750,000 dollars to spend and a short time to spend it. Meanwhile the Donovan family will only be able to dream about what might have been.
