These two states are permitted to get married in Massachusetts because they are the only two states that have ot out right banned or allowed same-sex unions. So they want to spread the love around. It is a small group of people but they will gather legal prescendence after a number of issues raise there head. For example… a couple from New Mexico get married in Massachusetts. In 5 years their jobs take them to Ohio. No suddenly they are no longer married? This will become an unacceptable dilemma in the eyes of some court. Or say they move to Ohio and they want a divorce?
After enough little cases it is possible that every state will be forced to recognize out of state same sex marriages regardless of their state Constitution. If one argues it on the basis of state’s rights then the issue of slavery will be invoked to silence any opposition or so distance them from the mainstream. Welcome to the new Rainbow America. Same-sex couples from the US state of New Mexico can get married in Massachusetts, state officials ruled this month, after determining that gay marriage had not been explicitly banned in New Mexico.
Massachusetts is the only US state to have legalised same-sex marriage. A gay rights group from the state asked officials to clarify the rules for out-of-state couples.
Along with Rhode Island, New Mexico is the only other US state that has not explicitly either banned or allowed same-sex unions.
